BouMatic Must Defend Breach of Contract Lawsuit Over Attorney Bonus

A Texas attorney will get another chance to fight for an annual bonus he says is guaranteed part of his pay in an oral agreement with a dairy equipment maker, after a state appeals court ruled Thursday.

The Texas Court of Appeals, Fourteenth District vacated and remanded the case, stating that while BouMatic satisfied its initial charge under the state’s anti-SLAPP statute, the plaintiff established prima facie evidence of his claim and BouMatic didn’t prove either of two defenses.
