Patrick Phelan, executive director of the New York State Association of Chiefs of Police, said during a press conference recently that the existing system has serious problems, but that the new law is not the solution.

Instead, this measure should be replaced by a system that could attempt to predict the potential threat someone might pose to the public upon release.

“We demand that judges, elected by the people of New York, consider the accused’s danger to the community, as is permitted in 49 other states,” Phelan said.

Opponents of this standard say it could be used for racial profiling, which would be counterproductive to the original goals of the bail reform, one of which was racial justice among the imprisoned population.

Lt. Gov. Brian Benjamin was also asked about the question of bail reform and adopted a tone similar to that of the governor.

“Public safety is the central issue. We want to be fair, we don’t want illegal imprisonment or anything like that. We want to make sure we have safe roads and that the public is safe, ”said Benjamin.
