Surgeon mistakenly amputates a patient’s leg

  • A surgeon in Austria has been sentenced to compensation of 8,000 euros to the wife of an 82-year-old patient whose leg was mistakenly amputated, AFP reported, citing sources from the Linz Regional Court.

    In the indictment, prosecutors stated that the 43-year-old doctor made the mistake “grossly negligent” despite the defendant claiming that it was a “human error” and that it was unintentional.

    Who is liable for death due to a medical error?

    The defendant marked the wrong leg for amputation on an 82-year-old patient before he operated on him in a clinic in Freistadt in May of this year. She didn’t realize the mistake until two days later.

    Unfortunately, the patient could not wait for the case and died before starting on the matter.

    The medical facility management said their internal inspection had been completed and a medical error had been found.
